Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Effective from December 1st, 2022, all Moon Magic jewelry, including real gemstones and the following metals, 925 Sterling Silver, 18kt Rose Gold, 18kt Yellow Gold Vermeil, 14kt Solid Gold and 10kt Solid Gold comes with a 2 year warranty.
Our warranty is valid against any defects in our materials and/or workmanship. Our warranty does not include insurance against physical or accidental wear and/or damage.
Our warranty doesn’t cover lost items, scratches that come with normal wear and tear (like a bent ring or broken chain), improper use or storage of your jewelry, improper care of your jewelry including contact with household chemicals, hygiene products like make-up or perfumes, discoloration of stones caused by water, chemicals, sweating, make-up, cooking, prongs wearing out, stones lost by everyday wear, natural inclusions and imperfections of stones and any modification to your jewelry done by a third party outside of Moon Magic Jewelry. Please Note: Items purchased through a third-party vendor (outside of moonmagic.com or shop.moonmagic.com) will not be covered under Moon Magic warranty. Please reach out to the company the items were purchased from.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Moon Magic and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Conditions of participation in our Moon Magic Giveaway.

By participating in the competition, the participant accepts the present conditions of participation. The competition has no connection to Facebook and Instagram and is in no way sponsored, supported or organized by Facebook and Instagram. Facebook and Instagram are not available as contact persons for the competition. The organizer is Moon Magic Jewelry.

Conditions of participation:

• Participation is free.
• Eligibility is for those aged 18 and over.
• Participation with fake identities or with the identities of third parties is not permitted.
• Employees of Moon Magic Jewelry and their relatives are excluded from participation.
• Participation via competition associations, entry services or automated participation are excluded.
• Each participant may only take part in the competition once per email address.
• In order to participate in the competition it is necessary that the user enters his / her email address on the competition page and confirms his / her registration by email. With the confirmation, the consent is given to receive emails from Moon Magic Jewelry for advertising purposes.
• The participant takes part in all collection raffles in the competition period. It is possible to unsubscribe from the mailing list at any time. Please note that only active subscribers will be taken into account in the draw.
• No product purchase is required to participate in the competition.
